Terms

The terms,without thefog.

These cover the use of this website and summarise how we contract for work. The binding terms for any project are in the proposal and services agreement you sign — never buried here.

Who these are with

“We”, “us” and “Past 7PM” mean the business operating this website. “ You” means anyone using it. By using the site you accept these terms; if you do not accept them, please stop using it.

What this site is

An information site describing services we offer. Nothing on it is an offer capable of acceptance, and nothing on it forms a contract. This site publishes no prices: every figure is quoted for your specific scope and confirmed in writing before you commit to anything.

Accuracy of what you read here

We take real care to keep the descriptions here accurate, and we deliberately avoid publishing performance statistics we cannot evidence. Even so, descriptions of what a system can do are general: what it will do for your business depends on your business, and is set out specifically in your proposal rather than inferred from this site.

How engagements actually work

This is a summary for transparency, not the contract itself. Every engagement is governed by a signed proposal and services agreement which sets out scope, price, timeline and responsibilities. Where anything here conflicts with that agreement, the agreement wins. As a rule:

  • Scope, price and timeline are agreed in writing before work starts.
  • Ongoing systems run on a minimum initial term that covers the build, then continue month to month.
  • You own the deliverables — code, configurations, content, accounts, numbers and data — and they are created in accounts belonging to you.
  • We retain ownership of our own pre-existing tools, methods and internal libraries, and license you to use them for as long as you use the system they sit inside.
  • Either party can end an ongoing arrangement on notice set out in the agreement. We will help with handover rather than obstruct it.

What we need from you

Systems are only as accurate as the information they are built from. You are responsible for the accuracy of the prices, services, availability and policies you give us, and for having the right to use any content, brand assets or customer data you ask us to work with.

Where a system contacts your customers — by call, SMS, WhatsApp, email or otherwise — you are the sender in the eyes of the law. You are responsible for having a lawful basis and any required consent for those contacts. We will build to the rules and tell you where we think a request crosses a line, but we cannot consent on your behalf.

Things we will not build

We decline work that requires suppressing genuine customer reviews, sending messages to people who have not consented where consent is required, having an automated system deny being automated when asked directly, or impersonating a named individual. This is not negotiable, and it is not a pricing matter.

Intellectual property in this site

The text, design, code and structure of this site belong to us. You are welcome to read it, quote it with attribution, and share links to it. You may not copy it wholesale to operate a competing site, which is a specific and common thing in this industry rather than a theoretical concern.

Third-party platforms

The systems we build depend on services operated by others — telephony carriers, messaging platforms, AI model providers, advertising networks and CRMs. Those platforms set their own rules, prices and availability and can change them. We will tell you when a change affects you and adapt the system where we can, but we do not control them and cannot guarantee their uptime, pricing or continued existence.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Subject to that, this website is provided as is, and we are not liable for losses arising from reliance on it.

Liability in respect of paid work is dealt with in the services agreement, where it is capped and allocated explicitly rather than left to a website footer.

Governing law

The governing law and the courts that have jurisdiction are set out in the services agreement for each engagement, and are agreed with you in writing before work begins. If you need to know the position before you engage us, ask and we will tell you.

Changes

We may update these terms. The date at the top always shows the current version. Changes apply to use of the site from the date they are posted, and never retrospectively to a signed agreement.
